Attached is the code I'm using, it first checks if the file can contain java, then walks up the PsiElement tree till it finds a PsiMethod element, and if there isn't a comment attached, addBefore()...

The codes running from inside a DocumentListener and only seems to trigger if I type fast.I'll rip the code out into a small plugin that hopefully reproduces it.

Actually, I knew I missed something ( was late ).THe javadoc also has {@ on the first line ( as thou you're starting to write something and havn't yet finnished ).I'll take another look at it.
